This new system is going to be terrific for homebrew, however piracy wise... I give up. I have pirated DS games and many other stuff, but I find myself just 'not' enjoying the games as much as I would if I purchased them...

From the looks of it, I guess this new variant uses a very similar OS compared to the original consoles. This is great actually.
The DSi OS and the DS (Lite) ones were rather different.

Yes, both versions have it. That's why it is N3DS (LL). The larger one has it too, in addition to the smaller model.
Let me fix the previous post to avoid confusion.
Battery life has been slightly improved on both models, up to 7h/6h using 3DS software and 12h/10.5h using DS software on the bigger/smaller consoles respectively.
The new 3DS screen is larger than the original by about 1.2X.
Both models will have auto brightness.

I think the biggest problem with the DSi is that very few 'huge' titles were actually made for it/enhanced. With Xenoblade, Nintendo is obviously trying to shake off that perception.
