Nothing says "we love our fans" like suing them for using officially licensed products after having taken all their money. It's stellar PR strategy, nothing screams "community engagement" like suing people on other planets too.
Nintendo Won again against GBATEMP back in the mid 2000s.
It used to host GBA and NDS roms but Admins chickened out and deleted everything fearing a multi-millionare lawsuit.

I think GBAtemp needs to sue Nintendo first, catch them off guard

They will just rename the site to 3DSperm.net and become very ambiguous.
If Nintendo still sue, admin will say "it's not 3DS perm, it's 3D Sperm." It will be something up to interpretation
