You pretty much nailed it. See post above. Because Nintendo has become soulless, greedy and lazy and will come after anyone who shows hackers can do much better than them, while other companies like Sega or Capcom can give fan works recognition and sometimes even officially release them. Nintendo's reactions are completely disproportionate to the level of "threat" this kind of fan project really poses to their IPs (see post below). It would be so much smarter of Nintendo to tolerate them and even recognize fan works which deserve to be. Hacks like Super Mario Bros 3Mix or Super Mario Bros Special 35th Anniversary Edition should have been picked up and released officially. This can be seen as an investment : they allow some copyright infrigements that are negligible in terms of sales repercussions, but this is repaid by a better image in the fanbase, and officially released fan works can also generate money, etc. Nintendo are also hypocrites because they copied & pasted the SMW hacks bubble flower in Super Mario Wonder, thus acknoledging they need fan hacks to create new stuff while still hunting them down. Case in point : so what does Nintendo have to gain by being greedy assholes shutting down every fan project ? Since the mainstream public won't hear about it, since emulation/hacking are very niche, it's not gonna hurt their sales. No one is gonna refrain from buying the Link's Awakening Switch remake because some obscure fanmade PC port is available. They're ruining their image to many fans for a few dollars, basically.
