And yup, I think the MS smear+buy tactic is legal. I mean it doesn't count as inside trading or anything like that. It's actually quite common to see financial institutes doing shorting this way: get large loans in stocks (from other parties), sell them while going out with news about how their own "experts" thinks this stock is going to crash (which it will, perversely self fulfilling), and then buy the stocks back for much less...

Well, to end things on a happier(?) note, "buy them out, boys!"
