if the multirom selection is done via an in-console application it is detectable. The button pressing method of the sky3ds - in theory - is undetectable. Maybe Nintendo can detect the sky3ds by some odd timing behaviour like comparing read/write times from and to the cartridge...

Ok I think I get it. Once the wad is in the nand the wii automatically thinks it's legit and just boots it up, since the nand is not "portable" (at least for the normal wii user).
Because SD-Cards are easily swapped the wii checks the signiature at every launch ... ok.
