You don't seem to understand how the process works. They may be due out next month, but the cartridges likely have already been mass produced or is almost done being mass produced. They'll likely have a pre 9.3 FW update bundled with them. I wouldn't be surprised if they still have 8.x updates on them.

I'm going to buy a Australian NEW 3DS XL (already got a standard NEW 3DS) can I setup without being harassed to update the firmware if I don't connect to the WiFi?

Edit: The issue is WiFi needs to be ON to turn off SpotPass to stop Auto-updates. (I have the URL's blocked on the router) That should be safe enough right?

I know that Australian NEW 3DS's come with 9.2.0.20 installed. I just don't want to give it a change to update and to disable it trying to ever check.

If you have a gw there is no problem , as with bigbluemenu you can just install the patchs if youre missing any

dont worry too much about the update nag im assuming it would be fairly simple for gateway to just wipe the pre-downloaded update or something.....it was never really a issue for 4.x users so they probably never bothered looking into it

Hi,

The fact that it supports MultiROM is enough to have something easy to patch.

if the multirom selection is done via an in-console application it is detectable. The button pressing method of the sky3ds - in theory - is undetectable. Maybe Nintendo can detect the sky3ds by some odd timing behaviour like comparing read/write times from and to the cartridge.

Pressing the button on the sky3ds has the same effect as removing the cart, plugging in another sd-card and reentering the cart.

Unless Gateway found the signing keys (not the same as the per console encryption keys. It's an extra encryption step that Bootrom has when booting the contents of the internal NAND), they can't just "modify" the contents of the internal sysnand which is where the system update is downloaded. (it is NOT stored on the SD card!). If they removed the update from sysnand it would break the hash check and cause a blue screen the next time the system boots up. Aka, you'd brick the console!

This is why we don't have a perma-CFW like exploit installed. Even Gateway 4.5 requires you to redo the exploit if the system is ever rebooted and the same is likely true for Gateway 9.x support. This is regardless of whether or not it would be a good business decision for them to even try to allow this.

Unless of coarse they found a bootrom exploit (the read only part that handles the console specific hash checks and boots up the encrypted NAND). If that's the case, no firmware update can ever fix that. But I doubt Gateway would be aware of this, and if they are, they sure as hell won't devolge it since perma-CFW would be an inevitability if the exploit ever went public.

The card needs to be fed in order to just work. The moment the card executes the switch of games, there's still current being sent to the card. There, you have a very simple flaw.

pretty sure that with kernel access you can delete any extra bits like downloaded updates....you couldnt change anything in the system firmware itself as that would break signature checks....but simple modifications that are already done by the system like setting up wifi etc are not signed using a private key, that's all done by system keys, which ofc the system/kernel has access to

Or you know, they could just update the card to change on power cycle instead if they ever blocked it like this. Aka, If you physically ejected the card and reinserted it. There's no software check in the world that can detect that without blocking legitimate carts and if they can accurately replicate the timings of legit cards which is not out of the question (perhaps might require buying a new cart, but do able). There might not be a way to prevent it from working.

The best Nintendo could do is ban the header of the game from online use. But one could just replace the game with a new header. Sky3DS prevents that currently. (for utterly retarded business reasons. It's been proven that there's no technical reason why they can't allow more then 10 game or why they don't allow switching the 10 you have to new games)

It may be awhile before Nintendo finds a way to block it. I think the best they could do is block Card1 games from booting from it properly.

I don't know if it is or not. But what is stopping them or someone else with a new clone to simply provide a new version of the cart to get around the block? Besides I'm sure the next clone of Sky3DS or Gateway themselves would provide a version of the cart that does allow firmware updates to the flashcart.

But seriously if they have no way to make the card check for a certain name andlaunch an update off its own mSD, or don't have a reprogrammable logic controller then only hardware revisions are viable.
