I noticed that there is a volume slider on the system, unlike the DSi. I did a quick Google search, but I didn't find anything. I'm sure there is info on the subject matter, but right now asking here is easier for me.
Yes it can, the upper left button on the 3ds main menu is used to adjust the brightness and power saver mode.
The menu can be accessed anytime, even during a game. It will "pause" the game while you are at the menu, and then you can continue playing after you are done in the menu.

I wouldn't mind knowing myself if Super Mario 64 DS happens to turn off the screens. It didn't have brightness options, instead you could disable back-lighting.
